ADU Permits in Berkeley: a Homeowner's Guide

Berkeley runs ADUs through a Planning eligibility check first — and it now has an amnesty path for unpermitted units. Here's how it works.

Last updated October 2026. Rules change; always confirm current requirements with the city before you build.

Who handles your permit

In Berkeley, you start with the Land Use Planning Division of the Planning and Development Department (1947 Center Street, 3rd Floor, (510) 981-7500). Before you can file a building permit, Planning runs an eligibility screening: you submit the Building Permit Application, the city's ADU Checklist, a complete plan set, and an Address Assignment Application. Answer "yes" to every development standard on the checklist and you're clear to file; a single "no" sends you back to revise first.

What you can build

California state law sets the baseline, and Berkeley follows it:

1,200 sq ftMax for a detached ADU
16 ftHeight limit for most detached ADUs
4 ftMinimum rear and side setbacks, detached ADUs
1 + 1One ADU plus one Junior ADU per single-family lot
60 daysDeadline to act on a complete application

There is no minimum lot size for an ADU under state law. Converted garages and other existing structures keep their current footprint.

Berkeley's amnesty program

In January 2025 Berkeley launched a pilot amnesty program aimed at legalizing unpermitted ADUs. Homeowners can bring an existing unit up to code without facing penalties: you document the property, a city inspector evaluates the unit against current safety and building codes, you develop a compliance plan with a licensed professional, then permit and complete the corrective work.

Separately, the city has been discussing whether ADUs could be sold as individual condominium units — a policy that would change the math for some homeowners, but it remains under discussion, not adopted.

Amnesty still means construction. The inspection almost always finds corrective work — electrical, egress, fire separation. Budget for it before you start the process.

What goes into the submittal

Berkeley's Planning screening asks for:
